Homeowners Association Sun Valley Rules & Regulations
(Amended March 15, 2006)
The intent of these rules is to enable all homeowners to enjoy the use of the lakes and lake peripheries in SUN VALLEY and at the same time provide those homeowners whose homes are situated on lakes to have the privacy and quiet to which they are entitled.
1. Lakes and their peripheries that are contiguous to homes may only be used by the homeowners that are adjacent to them. These homeowners may only use the area immediately behind their properties. Homeowners whose properties do not back onto a lake are free to use the lakes that are not surrounded by homes.
2. Boats, no larger than 12 feet in length including toy boats, are permitted in all lakes. Internal combustion motors are not permitted in all lakes.
3. Storage of any craft or other items is not permitted in any lake or the periphery of any lake. Such items must be stored on the homeowner's property out of view from the street and/or other neighbors.
4. Fishing in lakes with lines and hooks is permitted by homeowners and their guests. Net fishing is NOT allowed.
5. Loud radios and other sound producing instruments or devices are not permitted on the lakes or lake peripheries.
6. Littering, including fruits and vegetation, is forbidden in lakes or lake peripheries.
7. Illegal activities in the lakes, lake peripheries or any common area in SUN VALLEY is strictly forbidden and will be reported to the authorities.
8. Swimming in the lakes is not permitted.
9. Residents may not destroy or disturb any plant life growing in the lakes.

1. Hanging laundry is permitted in SUN VALLEY as long as the laundry is shielded from view by appropriate fencing and/or foliage.

Recreational Vehicles, 
Boats, Trailers, and 
Commercial Vehicles

1. Recreational vehicles, boats and trailers are not to be stored on any driveway or streets for more than a twenty-four hour period, without permission from the SUN VALLEY BOARD OF DIRECTORS. Any boat or trailer stored in rear of homes must be substantially concealed with appropriate fencing. Fencing must be approved by ARC.


2. Work trailers or any equipment hitched onto a truck or vehicle is not permitted at any time by residents living in SUN VALLEY. However, yard maintenance trucks and trailers are allowed while services are being rendered.


3. Only ONE commercial vehicle per home is allowed. The vehicle must not be longer than twenty-six feet or taller than nine feet. Commercial vehicles or trucks belonging to vendors may be parked on the street only when necessary and while services are being rendered.

Parking of Vehicles Trash Handling Yard and Garden Waste Noises, Littering and Vandalism

1. All loud music or noises of a disturbing nature are prohibited.


2. All littering in SUN VALLEY is prohibited.


3. Any vandalism to SUN VALLEY property is prohibited and will be dealt with harshly.

Renters and Visitors

1. The homeowner of any property in SUN VALLEY is completely responsible for the actions of his/her tenants and guests.


2. Homeowner's must own the property within SUN VALLEY for a minimum of two years before said property can be rented or leased to tenants. Under EXTREME situations, an exception may be made with the approval of a majority of Board Members at a regular meeting.


3. All renters, lessees and/or sub-lessees shall be registered with the SUN VALLEY HOMEOWNER'S ASSOCIATION. It is the responsibility of the property owner to register the renter or lessee.

Architectural Review Committee “A.R.C.”

1. Any exterior modifications to your property must be approved by the ARC. This includes, but is not limited to, painting, major landscaping, pools, cement work and free standing lighting fixtures.


2. Proper permits and plans shall be submitted to the ARC and be approved before any work or change is made.


3. Approval by County permit does not eliminate the necessity of ARC approval, and does not mean that approval will be granted. These Rules and Regulations and the Sub-Declaration, when in conflict with a County permit, take precedence over the issuance of a County permit.


4. There is to be no playground equipment, including swings hung from trees, installed in front or side yards of homes if visible from the street. These items shall be put in back yards or concealed by a privacy fence, may be placed in side yards.


5. SUN VALLEY is located within the boundaries of PALM BEACH COUNTY, and all county regulations also apply.

Community Swimming Pool

1. Admittance to the community pool in SUN VALLEY is granted by paid membership only, and is subject to the regulations posted in the swimming pool area.


2. Members are permitted to have occasional guests who do not reside in SUN VALLEY. Pool members shall accompany and remain with their guests while using the pool.


3. Membership cannot be combined by two or more SUN VALLEY residents.


4. No above ground private swimming pools in SUN VALLEY are allowed, irrespective of the size or location. This rule does not apply to temporary, non-filtered, child pools concealed out of sight.

Chapter 4 Sec. 4-4.

(a)  Dogs.

     (1)   It shall be unlawful for any dog to be off the owner's property       (which property is exclusive to the owner and does not include       common areas) unless the dog is under the restraint or control of a       person by means of a chain, leash or other device or is sufficiently       near its handler to be under his direct control and is obedient to that       handler's commands or is caged/crated.

     (2)   It shall be unlawful for an owner to tie, chain, tether or confine by       electronic/radio device a dog on the owner's property within five (5) feet       of public property, public access, easements, common grounds or the       property of another without the consent of the owner of such property.


(b)  Cats.

      Unsterilized cats must be confined to the owner's property.       Unsterilized cats off the owner's property must be restrained or       confined humanely to prevent them from running at large and to       protect them from injury and disease.

Anti-Tethering Law
Effective July 1, 2011

It is unlawful to chain or tether an animal outdoors at any time, day or night (County Ordinance 98-22).


“Tether” means to restrain an animal by tying the animal to any object or structure, (example: house, tree, fence, post, garage, shed) by any means, such as a chain, rope, cord, leash, running line, etc.


Should you choose to house your pet (s) outdoors:





  1. When the outdoor temperature falls below forty (40) degrees Fahrenheit, pets must be moved indoors or provided adequate heating.
  2. When the outdoor temperature rises above eighty-five (85) degrees Fahrenheit all dogs, cats, and small domestic animals must be provided air conditioning, a fan, or another cooling source.

Animals Creating Nuisances
Chapter 4 Sec. 4-5.

(a) The owner having control or custody of any dog, cat or psittacine bird that:


  1. Habitually barks, whines, howls, squawks or causes other objectionable oral noise resulting in a serious annoyance to a reasonable person, shall be deemed to be committing an act in violation of this section; or


  1. Disturbs the peace by habitually or repeatedly destroying, desecrating or soiling public or private property, chasing persons, livestock, cars or other vehicles, running at large, or other behavior that interferes with the reasonable use and enjoyment of the property, shall constitute a public nuisance.


(b) An animal control officer shall investigate an alleged violation of this section upon the receipt of two (2) sworn affidavits of complaint provided by the division, signed by two (2) unrelated county residents living in separate dwellings in the close vicinity of the alleged violation. For the enforcement of paragraph (a)(2) herein, one (1) of the affidavits may be

provided by a person who works for a recognized business or agency that regularly or frequently provides service in the close vicinity of the alleged violation. The affidavit shall specify the address or location of the alleged violation, the nature, time and date(s) of the act, the name and address of the owner or custodian, if known, and a description of the animal, if known.


(c) An animal control officer, upon the receipt of two (2) sworn affidavits of complaint as provided for in paragraph (b) herein, may issue a citation to the owner or custodian of any animal alleged to be in violation of this section.


(d) It is declared by the board that animals which bite, attack or threaten to bite human beings constitute a public nuisance.

(1)   Clean, sanitary, safe and humane conditions;

(2)   Sufficient quantities of appropriate food daily;

(3)   Proper air ventilation and circulation;

(4)   Adequate quantities of visibly clean and fresh water available at all times; and

(5) Medical attention and/or necessary veterinary care when an animal is sick, diseased or injured. Upon request by the division, written proof of veterinary care must be provided.





(1)   Leave an animal in any unattended motor vehicle;

(2) Transport an animal in any motor vehicle without adequate ventilation or in unsanitary conditions; or

(3)   Subject or cause an animal to be subjected to extreme temperatures that adversely affect the animal's health or safety.







Animal Care; Manner of Keeping
Chapter 4 Sec. 4-24.

The owner of every dog and cat shall be responsible for the removal of any feces deposited by his/her animal on public property, public walks, public beaches, recreation areas or private property of others.

1. The ball courts, tennis courts, playground equipment, etc., in the park area of SUN VALLEY, is for the use and enjoyment of SUN VALLEY residents and their guests. Residents are responsible for the actions of their guests.


2. Outsiders are trespassing and are not permitted to use these facilities.


3. The pool and park area closes at dusk and opens at dawn.

1. Each owner is required to maintain his/her property in a state of good repair at all times. This shall include but not be limited to periodic painting of all structures.


2. Each owner is required to maintain the lawns, shrubbery and trees in a well-groomed and trim condition.


3. The swale area in front of each home belongs to PALM BEACH COUNTY, and NO planting of trees or bushes is allowed.


4. No storage of any materials is allowed in front or side of any house if it is in view from the street.

1. Small amounts of garden waste must not be put out before 3:00 P.M. on the day before collection. This includes any amount of bagged material. Yard debris, except long branches, must be placed in appropriate containers.


2. Large amount of garden waste, such as tree cuttings, limbs and fronds may be placed out for collection no sooner than the weekend before the regularly scheduled pick up. This is to avoid double handling of large jobs. Try to schedule this work a day before collection if possible. No bagged material until day before applies.


3. If you hire a landscaping service, you must have them take the waste with them or leave it on the side or rear of your house, and then be put out for collection at the appropriate time. It is the homeowner's responsibility to advise the contractor of this rule and ensure compliance.


4. Covered trash containers and recycle bins are to be stored out of sight. This means the back or side, shielded, but preferably in garages.

1. Regulations for recyclable material are the same as trash handling as to time of placing at collection point and removal of containers.


2. Newspapers should be put in bags to avoid flying around, and put in yellow containers. It is suggested that the blue bin be put on top of the yellow paper bin to protect from rain and wind.

1. No trash in containers, bags or pails, boxes, etc., may be placed out at collection point sooner than 3:00 P.M. on the day before collection. Garbage must always be put in a trash container.


2. Collection point is in front of your home, only. If you are on a corner lot, you MAY NOT use the side of your lot for your collection point. Placing of trash in any other place in SUN VALLEY is a violation.


3. All trash containers must be removed from collection point on the SAME DAY as collection takes place.


4. Any debris falloff from trees, broken branches or bags, etc., must be cleaned up by the resident after collection has taken place.


5. Covered trash containers and recycle bins must be stored out of sight, not visible from the street.

1. There is to be no regular parking on the lawn, swales, or streets in SUN VALLEY. Temporary parking on streets, but not partly on lawns, is allowed for parties and special occasions. Please use driveway and garage.


2. Owners cannot park their vehicles on common grounds or any property that does not belong to that homeowner except where consent is given by another homeowner. Upon special approval from SUN VALLEY BOARD OF DIRECTORS, the Recreation Parking Lot may be used for special events.

1. Posting of one sign announcing a garage sale is permitted in front of your own house and one at the front of the community.


2. Real Estate signs for sale, or rent are permitted on your property not in the swales or common areas. Open house signs are permitted only during the tune period of the open house. Any other sign posting is subject to removal and fine.

1. Two garage sales per calendar year per residence are allowed by permit only from SUN VALLEY BOARD OF DIRECTORS.


2. Only used items from your own home may be sold. Bringing outside merchandise in for sale is subject to a fine.


3. A garage sale permit must be obtained from the SUN VALLEY BOARD OF DIRECTORS before the sale. Allow sufficient time for your request to be granted.

1. All external television antennas are prohibited. As of December 31st, 2000, any existing antennas are grand fathered in, but must be removed if the resident moves or the house is sold or as otherwise ruled by FCC.


2. Satellite receivers are allowed in SUN VALLEY as long as they are substantially shielded from view by appropriate fencing or foliage. Plans must be approved by the ARCHITECTURAL REVIEW COMMITTEE in accordance with ARTICLE VIII of the Sub-Declaration or as otherwise ruled by FCC.
